Terms of Service

Effective July 8, 2026

These Terms of Service (“Terms”) govern your access to and use of Whissle(“Whissle,” “we,” “us”) and our AI voice-agent platform at platform.whissle.ai (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Your account

You must provide accurate information when creating an account and keep it up to date. You are responsible for the activity under your account and for keeping your credentials secure. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

2. Acceptable use

You agree not to use the Service to:

  • break the law, or send unlawful, harassing, deceptive, or fraudulent communications;
  • place calls or send messages without the consent required by applicable law (e.g. telemarketing, recording, and messaging rules);
  • infringe others’ rights, or upload content you don’t have the right to use;
  • disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service;
  • resell or abuse the Service in a way that harms Whissle or other users.

You are responsible for ensuring the calls, messages, and data your agents handle comply with all laws applicable to you and your contacts.

3. Messaging program (SMS)

When you (or a business you contact) configure SMS, Whissle sends transactional text messages such as appointment confirmations, reminders, and reschedule or cancellation notices. This program does not send marketing messages.

  • Message types: appointment confirmations, reminders, and related transactional notices.
  • Message frequency varies with your activity.
  • Message and data rates may apply.
  • Reply STOP to opt out at any time, or HELP for help.
  • Carriers are not liable for delayed or undelivered messages.

4. Your content

You retain ownership of the data you put into the Service (contacts, recordings, transcripts, templates, and configuration). You grant Whissle the limited rights needed to host and process it in order to provide the Service. You are responsible for having the necessary rights and consents for that data.

5. Third-party services

The Service integrates with third parties you choose to connect (e.g. Google Calendar, Gmail, Google Sheets, Twilio, and AI providers). Your use of those services is also governed by their terms, and we’re not responsible for third-party services.

6. Fees

Paid features are billed as described at sign-up or in your plan. Usage-based charges (such as calls and messages) accrue as you use them. Unless required by law, fees are non-refundable.

7. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee the Service will be uninterrupted, error-free, or that automated transcriptions or AI responses will be accurate. You use the Service at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, Whissle will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to Whissle or others. On termination, your right to use the Service ends and we may delete your data as described in our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. We’ll post the updated version here and revise the “Effective” date; material changes will be communicated through the Service. Continued use after changes take effect means you accept them.
